Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the RAGE application ("App") and related services ("Service") provided by DGTL TECH LLC, a Wyoming limited liability company ("Company", "we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Service Description

RAGE provides secure proxy services that encrypt your internet connection and route your traffic through secure tunnels. The Service is designed to enhance your online privacy and security.

3. Eligibility

You must have the legal capacity to enter into a binding agreement in your jurisdiction to use the Service. If you are a minor, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms and is responsible for your use of the Service.

4. Account Registration

To access certain features, you may need to create an account. You are responsible for:

• Providing accurate and complete information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account

5. Subscriptions and Payments

5.1 Subscription Plans

The App offers auto-renewable subscription plans:

• Monthly subscription
• Annual subscription

5.2 Payment

Payment will be charged to your account at confirmation of purchase. Subscriptions are processed through the platform where you downloaded the App:

• App Store: Payments are processed through Apple's In-App Purchase system and charged to your Apple ID account
• Google Play: Payments are processed through Google Play's billing system and charged to your Google account

5.3 Auto-Renewal

Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

5.4 Managing Subscriptions

You can manage and cancel your subscriptions through the platform where you made the purchase:

• App Store: Go to Settings → Apple ID → Subscriptions on your device, or visit apps.apple.com/account/subscriptions
• Google Play: Go to Google Play Store → Menu → Subscriptions, or visit play.google.com/store/account/subscriptions

Any unused portion of a free trial period will be forfeited when you purchase a subscription.

5.5 Refunds

Refunds are handled by the platform where you made the purchase:

• App Store: Contact Apple Support or use the "Report a Problem" feature at reportaproblem.apple.com
• Google Play: Request a refund through Google Play at Google Play Help

6. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Distribute malware, viruses, or malicious code
• Engage in fraud, phishing, or identity theft
• Send spam or unauthorized communications
• Harass, threaten, or harm others
• Access or attempt to access systems without authorization
• Interfere with the operation of the Service

We reserve the right to suspend or terminate your access without notice if you violate these Terms.

7. Privacy and Data

We are committed to protecting your privacy. Our data practices include:

• We do NOT log your browsing activity or connection history
• We do NOT store your original IP address on our servers
• We collect minimal data necessary to operate the Service

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• UNINTERRUPTED OR ERROR-FREE OPERATION

We do not warrant that the Service will meet your specific requirements or expectations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DGTL TECH LLC SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Any damages arising from your use or inability to use the Service

Our total liability shall not exceed the amount you paid for the Service during the three (3) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless DGTL TECH LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by other means. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

12. Termination

We may terminate or suspend your access to the Service at any time for violation of these Terms. We will make reasonable efforts to notify you before termination, except where immediate action is required to protect our Service, other users, or comply with legal obligations.

You may terminate your account at any time by canceling your subscription and discontinuing use of the Service. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of such courts.

15. Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and DGTL TECH LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration, rather than in court, except that either party may seek injunctive relief in court for intellectual property infringement.

No Class Actions: You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action, class arbitration, or representative action.

Arbitration Rules: Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, and judgment on the award may be entered in any court of competent jurisdiction.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to within 30 days of first using the Service. If you opt out, you and DGTL TECH LLC may pursue claims in court.

16. Intellectual Property

The Service, including its original content, features, functionality, and design, is owned by DGTL TECH LLC and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The RAGE name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of DGTL TECH LLC. You may not use such marks without our prior written permission.

17. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, or cyberattacks.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DGTL TECH LLC regarding the use of the Service and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written.

20. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by DGTL TECH LLC.

21. Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be null and void.

22. Export Compliance

The Service may be subject to export control laws and regulations of the United States and other jurisdictions. You agree not to use, export, or re-export the Service in violation of any applicable laws, including U.S. sanctions administered by the Office of Foreign Assets Control (OFAC).

23. Apple App Store Terms

The following terms apply to the App downloaded from the Apple App Store:

• Agreement Parties: This agreement is between you and DGTL TECH LLC only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
• License Scope: You are granted a limited, non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the App on a device you do not own or control. Family Sharing or volume purchasing by approved organizations is permitted where available.
• Maintenance and Support: DGTL TECH LLC is solely responsible for providing maintenance and support services for the App. Apple has no obligation to provide any maintenance or support services.
• Warranty: DGTL TECH LLC is solely responsible for any product warranties, whether express or implied by law. If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Product Claims: DGTL TECH LLC, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar legislation.
• Intellectual Property: In the event of any third-party claim that the App infringes that party's intellectual property rights, DGTL TECH LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim.
• Legal Compliance: You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Terms: You agree to comply with applicable third-party terms when using the App, including the Apple Media Services Terms and Conditions.
• Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of this agreement. Upon your acceptance of these Terms, Apple has the right to enforce this agreement against you as a third-party beneficiary.
